
If you use hazardous chemicals on site, the model WHS Regulations require you to keep the current Safety Data Sheet (SDS) for each one, maintain a chemical register, risk-assess the chemicals you work with, label and store them correctly, and give your workers access to the SDS. An SDS is only "current" if it was prepared or last reviewed within the past five years - anything older is out of date by definition. The trap most contractors fall into is treating all of this as a once-a-year task: tidy on audit day, stale three months later. Compliance that only exists on the day the auditor visits is not compliance - it is a snapshot.
The difference between a business that passes and a business that is actually safe is whether chemical compliance is live. When a crew brings a new product on site, its current SDS has to be fetched, a risk assessment and a register entry created, and the whole register swept for currency on a rolling basis. What does the law actually require for SDS and chemical registers?
Under the model WHS Regulations (adopted in most Australian jurisdictions), a person conducting a business or undertaking (PCBU) that uses, handles or stores hazardous chemicals has a set of connected duties. None of them is optional, and none of them is a one-off.

The register and the SDS collection are the spine of the whole thing. If they are accurate and current, the rest has something true to hang off. If they are stale, every downstream control is working from bad information.
Why do chemical registers go stale?
Because sites change faster than paperwork does. A register is only ever a photograph of a moment. The moment it is printed, it starts ageing:
- A subcontractor turns up with a two-pack product nobody logged.
- A supplier reformulates and reissues the SDS - your copy is now superseded even though the label looks identical.
- An SDS quietly crosses its five-year currency line with no alarm attached to it.
- The one person who "knows the chemicals" goes on leave, and the folder stops being maintained.
None of these are dramatic failures. They are drift. And drift is exactly what an auditor - or worse, an incident investigation - exposes. The honest problem is not that contractors do not care; it is that a paper folder or a shared drive has no way to notice that it has gone out of date. Nothing sweeps it. Nothing raises its hand.
This is the real difference between holding a certificate or an annual snapshot and running a system that stays current between audits. A certificate tells you that on one day, someone checked. A living system tells you that today, right now, the register matches the site.
What does a live SDS system look like?
A living system treats "a new chemical on site" as a trigger, not an afterthought. The flow is simple and it runs every time, not once a year:
- A chemical is requested on site. A worker or supervisor flags that a product is coming on site - ideally from the field, on their phone, before it is used.
- The current, authentic SDS is fetched. Not a photo of a faded label, not last decade's version - the current manufacturer SDS, confirmed to be within its five-year currency window.
- A draft risk assessment and register line item are prepared. The system drafts the risk assessment and the register entry from the SDS and stages them - ready, but not yet live.
- The site HSEQ representative reviews and signs. A competent person reviews the draft, adjusts controls for the actual task and site, and approves. Human judgement stays in the loop; the software does the fetching and drafting, not the deciding.
- The register is swept for five-year currency on a rolling basis. Monthly, the whole register is checked with a forward lookahead, so an SDS approaching its expiry is re-fetched before it lapses - not discovered lapsed on audit day.
The two habits that make it "live" are the trigger and the sweep. The trigger means nothing new goes into use without being captured; the sweep means nothing already captured is allowed to quietly age out. Between them, the register stops being a photograph and becomes a feed.
